False Self Employment in Civil’s

The government said in its pre budget statement.

That it is concerned about false self-employment within the construction industry. This can result in an unfair commercial advantage and possible exploitation of vulnerable workers.

The Government will continue to work with the construction industry and others to find a way to address this problem, taking account of challenges facing the industry and its need for a flexible labour supply.

 

Not quite sure what they mean about this? But I suspect they intend taking a much harder line with employers who falsely allow the use of the CIS self employment scheme to negate NIC payments rather than apply the HMRC ‘employment status indicator’ and take the worker on as an employee for the duration of the job, even if it is a zero hours contract.

 

Given most contractors in the Inland Inshore abuse the CIS scheme, basing their claim that Divers are self employed when really they should be employees on zero hour contracts, the diving contractors should be prepared for that eventual knock on the door from HMRC and a large unpaid backdated claim for the employees tax and NI and the Employers NI.
